We make reasonable efforts to deliver orders within the estimated delivery time provided at checkout, but delivery times are estimates only and are not guaranteed. Factors beyond our control — including weather, traffic, and high order volumes — may affect delivery times.

It is your responsibility to provide an accurate and accessible delivery address. If you are not available to receive your order upon delivery, we may leave the order at the door at our discretion. Dewey's Pizza shall not be liable for orders that are lost, stolen, or damaged after delivery has been completed to the address provided.


7. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, photographs, images, audio clips, video clips, data compilations, menu designs, branding elements, and software, is the exclusive property of Dewey's Pizza or its content suppliers and is protected by United States copyright, trademark, trade dress, and other intellectual property laws.

The Dewey's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Dewey's Pizza or its affiliates or licensors. You must not use such marks without the prior written permission of Dewey's Pizza. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial purposes in connection with placing orders and using the Services. This license does not include the right to:

THE SITE AND ALL SERVICES, CONTENT, AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEWEY'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • Any warranty that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
  • Any warranty as to the accuracy, reliability, completeness, or timeliness of any content on the Site;
  • Any warranty that defects in the Site will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in their entirety. In such cases, warranties are limited to the maximum extent permitted by applicable law.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, INCLUDING THE LAWS OF THE UNITED STATES, DEWEY'S PIZZA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES;
  • PERSONAL INJURY OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR CONSUMPTION OF OUR PRODUCTS;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
  • ANY THIRD-PARTY CONDUCT ON THE SITE;
  • ANY ERRORS OR OMISSIONS IN ANY CONTENT ON THE SITE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the theory of liability — whether contract, tort (including negligence), strict liability, or otherwise — and even if Dewey's Pizza has been advised of the possibility of such damages.

Some states do not allow certain limitations on liability, so the above limitations may not apply to you in full. In such jurisdictions, liability is limited to the extent permitted by law.


10. Indemnification

You agree to defend, indemnify, and hold harmless Dewey's Pizza, its owners, officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way connected with:

  • Your access to or use of the Site or Services;
  • Your violation of any provision of these Terms;
  • Your violation of any applicable law, regulation, or third-party right, including intellectual property rights or privacy rights;
  • Any content or information you submit to the Site;
  • Your fraudulent, negligent, or willful misconduct;
  • Any dispute between you and any third party arising from your use of the Services.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You agree to cooperate fully with our defense of such claims. You may not settle any claim without our prior written consent.


11. Governing Law and Jurisdiction

These Terms of Service and any dispute arising out of or relating to these Terms, the Site, or the Services shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Dewey's Pizza operates, without regard to its conflict of law principles.

To the extent that any lawsuit or court proceeding is permitted under these Terms, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the United States having jurisdiction over Dewey's Pizza's principal place of business. You hereby waive any objection to the laying of venue in such courts and any objection that such courts are an inconvenient forum.

Your use of the Services may also be subject to applicable federal consumer protection laws, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce. Nothing in these Terms shall be construed to limit your rights under applicable federal or state consumer protection statutes.


12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to contact Dewey's Pizza at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. We will attempt in good faith to resolve the dispute within thirty (30) days of receipt of your notice.

12.2 Binding Arbitration

If the dispute cannot be resolved informally, you and Dewey's Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your use of the Site — including questions of arbitrability — shall be resolved by final, binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this Section. The arbitration shall be conducted in English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Waiver of Class Actions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims for small claims court relief may also be brought in an appropriate small claims court.

12.5 Opt-Out

You may opt out of the arbitration agreement within thirty (30) days of first accepting these Terms by sending written notice to [email protected] with the subject line "Arbitration Opt-Out." Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.


13. Term and Termination

These Terms shall remain in full force and effect for as long as you access or use the Site or Services. We may, in our sole discretion and without notice or liability, terminate your access to all or any part of the Services for any reason, including without limitation if we believe that you have violated any provision of these Terms.

You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account will not relieve you of any obligation to pay for orders already placed.

Upon termination for any reason:

  • Your right to access and use the Site and Services will immediately cease;
  • Any outstanding payment obligations remain in full force;
  • All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

Dewey's Pizza reserves the right to modify, amend, or replace these Terms of Service at any time in its sole discretion. Your continued access to or use of the Services after any changes to the Terms constitutes your acceptance of the updated Terms. 19. Severability

If any provision of these Terms of Service is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or void under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and all remaining provisions shall continue in full force and effect.

The parties agree to replace any invalid or unenforceable provision with a valid, enforceable provision that most closely achieves the economic and legal intent of the original provision.


20. Waiver

No failure or delay by Dewey's Pizza in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver of that right, remedy, power, or privilege. No single or partial exercise of any right, remedy, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege. Any waiver must be in writing and signed by an authorized representative of Dewey's Pizza to be effective.


21. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or policies published on the Site, constitute the entire agreement between you and Dewey's Pizza with respect to your use of the Site and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties — both written and oral — with respect to the subject matter hereof.

No oral or written information or advice given by Dewey's Pizza or its authorized representatives shall create any warranty not expressly stated in these Terms.
